What is an Unclaimed Fund?

An unclaimed fund is any financial asset whose owner (s) cannot be located, does not submit claim, for a specific period of time.

In the case of Puerto Rico, when is an amount  considered “unclaimed”.

.

For entities regulated and supervised by the applicable statues OCFI (Act 36 of 1989and Act 55 of 1933, as amended) require that an amount is deemed as unclaimed or abandoned on June 30 to the year that marks five (5) years of inactivity.  However, for credit unions and insurance matters, the Public Corporation for the Supervision and Insurance of Cooperatives (COSSEC) and the Office of the Commissioner of Insurance (OCI), respectively, administer their own laws.

What happens after five (5) years of inactivity occur?

.

The holder (whether a financial institution or other company) is required by such laws to submit a report each year by the 30th of June and transfer to the Office of the Commissioner of Financial Institutions (“OCFI”) all such sums of money or other liquid assets unclaimed or presumed abandoned.  In the case of unclaimed amounts of $100 or more, the holder is also obliged to publish notices in newspapers to notify the owners, that assets listed in the notice, will be remitted to the OCFI, if not claimed by November  30th.

What procedure follows when OCFI receives unclaimed funds?

The OCFI, is responsible for administering the Unclaimed Program of   Puerto Rico, submits to the General Fund of Puerto Rico money received from thousands of holders living in or outside of Puerto Rico, incorporating its electronic database information, making it available to the public thus  facilitating the search and eventual “refund” to the owners.

How do you know your audience?

.

Fulfilling its mission to ensure the public interest, the OCFI has established various mechanisms to alert the public of their existence as custodians, facilitate the search and eventual return to owners.   In addition to interviews and articles in the mass media, the OCFI offers lectures, seminars and “outreach” to educate the public in malls and other public places.

How can I find out if OCFI has an unclaimed fund belonging to me or my family?

.

The OCFI facilitates the search, no matter where you are located:

.

  • Visiting our office by appointment

  • By phone, toll free if calling from outside the metropolitan area

  • By fax or email

  • Through the Internet, accessing the database available on the website of OCFI or on a national basis

  • Using computers which OCFI provides to the public for its guidance and “outreach”

If I locate a given amount belonging to me, what should I do?

.

The (the) owner(s) must complete the provided form, sign and submit to the Division Unclaimed or Abandoned Funds, accompanying the necessary documents in order to process your claim.  For example, in the case of inheritance, in order to process your claim, a copy of the declaration of heirs must be submitted.

What is the waiting time for a claim to be processed?

.

You can claim pursuant to current  legislation under the following terms:

  • Funds reported by banks of Puerto Rico before February 14, 2012, shall have a term of 10 years to claim from the date the amount was submitted to OCFI.
  • Funds reported by Puerto Rico banks after February 14, 2012, shall have a term of three years, according to the amended law.
  • Funds reported for other institutions under the Act 36 of 1989, will be claim at any time.
